Eli Lilly sued American Peptides LLC in Louisiana federal court on 8 Oct 2026. The complaint isn't public. Which site, the 100/100 rating, what's next.

The diversity statement suggests Lilly is in federal court because the parties are from different states, not because it pleads a federal claim. The August and October complaints we have read against other sellers work that way: they plead state unfair-competition and consumer-protection counts. We do not know which counts this complaint pleads. Bloomberg Law summarised all five October complaints as alleging that the businesses "unlawfully sell and promote copies" of retatrutide.

What does Lilly's complaint allege?

We do not know yet. The complaint was filed but not available on CourtListener on 10 October.

For context only, this is what Lilly alleged in complaints we have read against other sellers. None of it is a claim about American Peptides:

  • The claim. Lilly alleges the seller markets "research use only" retatrutide that is in fact sold for human use, which Lilly says makes it an unapproved new drug under state law. See the Texas Peptides complaint, August 2026.
  • The relief. A permanent injunction against "marketing, advertising, distributing, dispensing, or selling any product containing or purporting to contain retatrutide", plus damages, disgorgement of profits, and fees.
  • The evidence. In the LiveWell complaint, filed the same day as this one, Lilly cites bacteriostatic water linked from the product page, customer and influencer posts about personal use, and affiliate discount codes. Our lawsuits overview lists those exhibits.

We do not know which pages, posts or products Lilly cites against American Peptides, or whether its claims follow the same pattern. When the complaint posts, we will add its counts and exhibits here with the date we read it.

Which American Peptides is the defendant?

Public records point to the company behind americanpeptides.us, but the filing has not confirmed it. What each record shows:

Three other names cause confusion:

  1. americanpeptides.com runs a white-label and drop-ship wholesale program. On 10 October its homepage said "americanpeptides.us was built on this exact system" and carried the footer "© 2026 American Peptides". That is the first public statement we have seen linking the two sites, but it is marketing copy. We found no registry record tying the .com site to the LLC.
  2. The American Peptide Association (americanpeptide.co) is a paid-membership industry group. It is not a party to any Lilly suit; RUO Codes noted the mix-up in early coverage.
  3. The American Peptide Society is a scientific society with no connection to any of this.

If a different American Peptides L.L.C. turns out to be the defendant, we will correct this section and log it on our corrections page.

Is American Peptides still selling?

americanpeptides.us is. We loaded it on 10 October 2026, two days after the filing:

  • The site opens behind a "researcher access" gate asking for an email and a field of research, with 20% off for confirming.
  • A "BOO-GO Weekend" banner offered buy-one-get-one-free on select peptides, ending 11 October.
  • The retatrutide listing at /products/retatrutide is headed "AP-RTA-3™", with "Catalog reference LY3437943 · CAS 2381089-83-2", in 10, 20, 30, 48 and 60 mg vials from $105. retaradar recorded the same five sizes as "RETA-GLP3" on 1 October, and our 9 October overview of the suits used the same name. We cannot date the change more precisely.
  • The "frequently bought together" box listed a reconstitution solution marked "REQUIRED", a reconstitution kit and alcohol prep pads.
  • None of the pages we read mentioned the lawsuit.

FDA warning letters and Lilly complaints against other sellers have cited code-name product listings. Neither has said anything public about this listing. Our code-name decoder lists the aliases; LY3437943 is Lilly's own development code for retatrutide.

What did the 100/100 rating say?

On 1 October 2026, seven days before the suit, retaradar.com scored American Peptides 100/100 and ranked it second of 24 retatrutide sellers. We checked the page again on 9 and 10 October. Both times it still showed 100/100, "Checked October 1, 2026", and no mention of the lawsuit. retaradar discloses that a different vendor pays for its first position.

The score passes six checks on shipping, payment options, quality claims, contact details, an outside rating and perks. None of them looks at legal exposure, so a seller can score full marks the week before a federal suit. retaradar's own notes, which do not affect the score, flagged the problems we describe in the next section, Trustpilot reviews posted "within hours of each other" on 30 September, and a $2,500 chargeback penalty in the terms.

Do any lab records exist for American Peptides?

None in our mirrors. Our Janoshik mirror (337 readable reports, 364 indexed, last crawled 30 June 2026) and our Kovera mirror (1,828 records, built 1 August 2026) hold no test with American Peptides as the client.

The vendor publishes Bioviridian certificates for each retatrutide size, and the lab hosts copies. We pulled both copies of certificate COA7580 on 10 October:

The lot, results, sample-received date (11 August) and chromatograms match. The sample name, the issue date and the sterility row differ, and the lab copy also carries an American Peptides logo over its chromatogram. I bought from American Peptides. What should I know?

Check two sets of rules: the store's terms, and the federal dispute rules that run between you and your card issuer.

  1. The store's terms. Its refund policy says "All Sales Are Final" once a product leaves the facility. Its terms say a chargeback filed without first writing to support and allowing "thirty (30) business days" may bring "a $2,500 liquidated damages fee".
  2. The federal clock. For a credit card, the FTC says your dispute letter must reach the issuer "within 60 days after the first bill with the error was sent to you" (FTC). Thirty business days is about six calendar weeks, so waiting out the store's window can use up most of yours. The CFPB's dispute steps apply whatever the store's terms say.
  3. Crypto and ACH. The store lists Bitcoin, Ether and USDT. Those payments carry no billing-error right.

What happens next in the case?

Watch for these entries on the docket:

  • Service and the answer deadline. Under Federal Rule 12, a defendant has 21 days after service to answer, or 60 days after the request is sent if it waives formal service. No service return was on the docket on 10 October, so the clock had not visibly started.
  • A motion to dismiss. Legendary Peptides, sued in August, moved to dismiss on 2 October, arguing Lilly cannot claim lost sales of a drug it does not sell. A ruling there would bear on this case's theory.
  • A dismissal or consent order. Lilly dropped its August case against Aesthetic Envy with prejudice on 11 September without giving a reason. A voluntary dismissal or agreed injunction can end a case quickly.
  • The product page. If AP-RTA-3 disappears from americanpeptides.us, that will be the first visible effect of the suit.

The page that retaradar recorded as "RETA-GLP3" on 1 October now heads its listing "AP-RTA-3", with "Catalog reference LY3437943", Lilly's code for retatrutide, in five vial sizes. A buy-one-get-one sale ran through 11 October. We saw no mention of the lawsuit.

Is americanpeptides.com the same company as americanpeptides.us?

Unconfirmed. americanpeptides.com runs a white-label and drop-ship wholesale program, and on 10 October its homepage said "americanpeptides.us was built on this exact system." Can American Peptides charge me $2,500 for a chargeback?

Its terms say it "reserves the right" to seek a $2,500 liquidated damages fee if you file a chargeback without first giving support 30 business days. Whether that clause holds up is a legal question we cannot answer. Your card issuer's 60-day dispute window runs from the statement date either way.
